These Terms of Service (“Terms”) are an agreement between you and Swadesh Mahato, an independent developer in Kolkata, India, publishing as “fusionfroze” (“Lune,” “we,” “us,” or “our”). They cover your use of the Lune app and the services behind it (“Lune”).

By creating an account or using Lune, you agree to these Terms and confirm that you’ve read our Privacy Policy. If you don’t agree, don’t use Lune.

1What Lune is#

Lune is a private ambient-presence app for two people. Once you pair with one partner, each of you can share a status, a mood, and short notes called “whispers.” Lune also shares your battery level, when you were last active and, unless you turn it off, your local time. Your partner’s latest presence appears in the app and on a home-screen widget. You can update yours from the app, or send a preset status or mood straight from the widget. When a whisper arrives, your phone can play a soft chime, and either of you can send the other a gentle nudge asking for a whisper.

Lune is one connection between two people. It isn’t a social network, a group chat, or a general messaging service. Lune is currently available for Android through Google Play.

Lune isn’t an emergency, safety, medical, or location service. Updates can be late, missing, or out of date (see section 7). Never rely on Lune to know whether someone is safe, where they are, or whether they need help. Your partner’s local time comes from their phone’s time zone setting, and it doesn’t show where they are. In an emergency, contact your local emergency services.

2Eligibility#

You must be at least 18 years old, or the age of majority where you live if that’s higher, and able to enter into a binding contract. You can’t use Lune if the law where you live prohibits it. By using Lune, you confirm you meet these requirements.

3Your account#

  • #Sign-in. You sign in with Google, or with a one-time code we send to your email. Keep that Google account or email inbox secure, because anyone who can get into it can get into your Lune account.
  • #One person per account. Don’t share your account, and don’t create an account for someone else.
  • #One phone per account. Lune is designed for one phone at a time. Each phone gets its own encryption key. If you sign in on another phone, the new phone’s key replaces the old one, and the old phone will stop decrypting new whispers. Having more than one phone signed in to the same account at the same time isn’t supported.
  • #Accurate details. Don’t use a display name that impersonates someone else or is offensive.
  • You’re responsible for everything done through your account, unless it happened because of our own security failure.

4Pairing#

  • #How pairing works. Each account has an invite code. When someone enters your code, the two of you are paired, provided neither of you is already paired. After pairing, and after a disconnect, both of you get new codes. Anyone who has your current code can pair with you while you’re unpaired, so only share it with the person you mean to pair with.
  • #Consent. Only pair with someone who knowingly wants to pair with you. Never pair with, or monitor, someone without their knowledge (for example, by using their phone).
  • #What your partner sees. While you’re paired, your partner can see your display name, moon color, status, mood (including any custom label you make active), whispers and which of them you keep, touches, check-ins, battery level, how long ago you were last active and, unless you turn it off in Settings → Connection, your local time. If one of you pays for Lune Pro, the other also sees that, including the renewal date and whether there’s a payment problem. Our Privacy Policy lists exactly what’s shared.
  • #Disconnecting. Either of you can disconnect at any time, in Settings → Connection or from the locked screen. Disconnecting ends the pairing straight away for both of you. To pair again, even with the same person, you need a new code, and the new pairing starts with an empty whisper history. The old pairing’s history stays stored in encrypted form on our servers, but you can’t see it in the app. It’s deleted when either of you deletes your account.

5Whispers and other content#

  • #Limits. A whisper is at most 60 characters. A custom status or mood label is at most 16 characters. A display name is at most 24 characters.
  • #Latest whisper and history. The widget shows only your partner’s latest whisper, so a new whisper replaces the one before it. The app’s history shows past whispers from your current pairing.
  • #End-to-end encryption. Whisper text is encrypted on your phone and can only be decrypted on your partner’s phone and yours. We can’t read it. Your display name, moon color, status, mood, labels, battery, last-active time, time zone, touches, check-ins, which whispers you keep, and pairing and subscription details are not end-to-end encrypted. To check that your partner’s key hasn’t been swapped, compare the safety number in Settings → Connection on both phones.
  • #No recovery. Your private key exists only on your phone, and we have no copy. If you reinstall Lune or change phones, your partner’s app re-encrypts your history for your new key the next time they open Lune. If both of you lose your keys before that happens, your whisper history can’t be recovered by anyone, including us.
  • #Your content is yours. You keep ownership of what you create in Lune. You give us a worldwide, non-exclusive, royalty-free permission to store, copy, transmit, and display it only as needed to run Lune for you and your partner. For whispers, that means handling the encrypted version. This permission ends when your content is deleted, except for copies we keep under our Privacy Policy (for example, in backups that expire on a schedule).
  • #You’re responsible for what you send. Only send content you have the right to share, and that complies with these Terms and the law.

6Your partner, and people who can see your phone#

Once something is on your partner’s screen, we can’t control what they do with it. They could take a screenshot or show it to someone else. Lune’s widget shows your partner’s presence, including their latest whisper, in plain view on your home screen, where anyone who can see your phone can read it. Only pair with someone you trust, and use your phone’s screen lock.

7Widget, notifications, and availability#

Lune refreshes widgets with silent background messages and periodic updates. How quickly those arrive depends on things we don’t control: Android, your phone’s maker, battery-saving settings, notification permission, network connectivity, and Google’s and Expo’s push services. Your partner’s widget may be slow to update, may show out-of-date information, or may not update at all.

Lune also uses four kinds of notification: a soft chime, with no text, when your partner sends you a whisper; a small notification when they ask you for a whisper (a “nudge”); a short vibration, with no text, when they send you a touch; and a notification with their first name when they send you a check-in (for example, “Sara is home safe”). Chimes don’t play while Lune is open on your screen. You can send one nudge every 30 minutes; one touch every 20 seconds, up to 30 an hour; and one check-in a minute, the same check-in once every 10 minutes, up to 12 a day. A check-in says only what your partner tapped and when. It isn’t proof that anyone is safe, or of where they are (see section 1). Chimes, nudges, touches and check-ins depend on the same things as widget updates, and on your notification settings, so they may be late or may not arrive.

We don’t guarantee that Lune will always be available, uninterrupted, timely, or free of errors. We may pause Lune for maintenance, and we may change, add, or remove features.

8Free trial#

  • #Length and start. Each account gets one free 7-day trial. It starts the first time you successfully pair, and you don’t need to give payment details.
  • #Once per account. Your trial is linked to your account. It doesn’t restart if you disconnect, pair again, or pair with someone new.
  • #Shared access. Your pair has full access while either of you has a trial running. So if one of you has used up your trial and pairs with someone whose trial hasn’t started, the new pairing starts that person’s 7-day trial, and it covers you both.
  • #When the trial ends. If neither of you has a trial running or an active subscription, Lune locks for both of you. While it’s locked, you can’t send or see status, mood, or whispers, you can’t send nudges, and widget updates and chimes stop. You can still sign in, see your partner’s name, subscribe, restore purchases, disconnect, or sign out. You can also delete your account using the form or email address in section 13. Your data isn’t deleted just because Lune is locked. Subscribing restores access.
  • #No trial resets. Creating new accounts, or pairing and re-pairing, to get more free time violates these Terms.

9Lune Pro subscriptions#

  • #Plans and billing. Lune Pro is an auto-renewing subscription, billed monthly or annually through Google Play. Prices, currency, and any taxes are shown in the app before you buy, and they come from Google Play for your store country. Google Play handles your payment, and we never see your card details. Your purchase is also subject to Google Play’s terms.
  • #One subscription unlocks the pair. If either of you has an active subscription, including any grace period Google Play allows after a failed payment, both of you get full access. The subscription belongs to the account that bought it.
  • #Auto-renewal. Your subscription renews automatically at the end of each period at the price in effect then, unless you cancel at least 24 hours before it renews, or earlier if Google Play requires. If the price goes up, Google Play will tell you in advance, and where required you’ll need to agree to the new price before it applies.
  • #Cancelling. You can cancel anytime in the Google Play Store under Payments & subscriptions → Subscriptions. Cancelling stops future renewals. You keep access until the end of the period you’ve already paid for. Uninstalling Lune, disconnecting, or deleting your Lune account doesn’t cancel your subscription.
  • #Refunds. Refunds are handled by Google Play under its refund policies. We can’t issue refunds directly, except where the law requires it. Nothing in these Terms limits any refund rights you have under consumer protection law.
  • #Restoring purchases. You can use “Restore purchases” to re-link a subscription bought on the same Google account. If you delete your Lune account while a subscription is active, we can’t guarantee that it can be moved to a new account.
  • #If you disconnect. Pro stays with the account that pays for it. The other person loses access unless they have their own trial running or a subscription. A new partner of the paying account gets access while paired with them.
  • #Promotions. We may sometimes offer promotional codes, discounts, or free periods through Google Play. They follow the terms shown with the offer and Google Play’s rules, have no cash value, and can’t be sold or transferred.

10First Light#

Accounts that paired during our founding period get a “First Light” mark, and the first 100 pairs got a “Crescent” number. First Light is a thank-you and nothing more. It has no monetary value, doesn’t include any discount or free access unless we clearly say so separately, can’t be transferred, and is removed if you delete your account.

11Acceptable use#

You agree not to:

  • harass, threaten, stalk, intimidate, coerce, or abuse anyone, or use Lune to control or monitor someone without their free and informed consent
  • impersonate anyone, or pair with or use someone else’s account or phone without permission
  • send illegal content, including content that exploits or sexualizes minors, or content that infringes someone else’s rights
  • try to get into another person’s account or data, or probe, break, or get around our security, encryption, or access rules
  • bypass the paywall, trial, or entitlement checks, or abuse invite codes, accounts, or pairing to get free access
  • scrape, overload, disrupt, or interfere with Lune or our providers, or access Lune by automated means other than the official app
  • copy, modify, decompile, or reverse engineer Lune, except where the law expressly allows it
  • use Lune for anything commercial, or for anything illegal

12Suspension and termination#

We may suspend or close your account, or restrict features, if we reasonably believe you’ve broken these Terms or the law, created a risk to others or to Lune, or if we’re required to by law. Where it’s reasonable and lawful, we’ll tell you why and give you a chance to respond. You can stop using Lune at any time, and you can delete your account (see section 13).

If we decide to shut Lune down entirely, we’ll give you reasonable advance notice in the app or by email where we can.

Sections 5 (your permission to us, to the extent it survives), 12, 13, and 15 to 20 continue to apply after your account ends.

13Deleting your account#

While you’re paired and have access, you can delete your account yourself in Settings → Account → Delete account. At any time, including while you’re unpaired or Lune is locked, you can ask us to delete it at https://tally.so/r/9qPXE1 or by email. We may ask you to prove the account is yours.

Deleting your account is permanent and can’t be undone. If you’re paired, you’re disconnected first. Then we delete your profile, your presence, your invite codes, every pairing you’ve been part of, and all the whispers in them, including your partner’s. Your current and former partners will lose that shared history as well. Our Privacy Policy lists the limited records we keep (such as billing event records) and explains why.

Deleting your Lune account doesn’t cancel a Google Play subscription. Cancel it in the Play Store.

14Third-party services#

Lune relies on services run by other companies. These include Google (sign-in, Google Play billing, and Firebase Cloud Messaging), Expo (push delivery), RevenueCat (subscription management), and Supabase (hosting and sign-in). When you use them through Lune, their own terms may apply to you as well. We aren’t responsible for how those services perform or what they do.

15Our intellectual property and your feedback#

Lune, including its app, design, artwork, scenes, text, and software, belongs to us or to our licensors. As long as you follow these Terms, we give you a personal, non-exclusive, non-transferable, revocable license to use the Lune app on your own device for your personal, non-commercial use. We keep all rights we don’t expressly give you.

If you send us feedback or suggestions, you allow us to use them without owing you anything or crediting you.

16Disclaimers#

Except as expressly stated in these Terms, and to the fullest extent the law allows, Lune is provided “as is” and “as available,” without warranties of any kind, whether express or implied. This includes warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy. We don’t promise that Lune will be uninterrupted, timely, secure, or error-free, or that presence information (including battery, last-active time and your partner’s local time) will be accurate or up to date.

Some countries don’t allow certain warranties to be excluded. If you live in one of them, this section applies only as far as the law allows, and your statutory consumer rights aren’t affected.

17Limitation of liability#

To the fullest extent the law allows, we aren’t liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, whisper history, profits, goodwill, or relationships, arising from or relating to Lune or these Terms. This applies even if we were told such damages were possible.

To the fullest extent the law allows, our total liability for all claims relating to Lune or these Terms is limited to the greater of: (a) what you paid for Lune in the 12 months before the event that led to the claim, or (b) USD 50.

Nothing in these Terms limits or excludes liability that can’t be limited or excluded under applicable law, such as liability for fraud, or for death or personal injury caused by negligence.

18Indemnity#

To the extent the law allows, you agree to cover us against claims, losses, and reasonable costs (including legal fees) arising from content you send through Lune, from your misuse of Lune, or from your breach of these Terms or the law. This doesn’t apply to consumers in countries where such an obligation isn’t allowed.

19Changes to these Terms#

We may update these Terms from time to time, and the “Last updated” date will change when we do. If a change is significant, we’ll tell you in the app or by email before it takes effect. Continuing to use Lune after a change takes effect means you accept the updated Terms. If you don’t agree, stop using Lune and delete your account (and cancel any subscription in Google Play).

20Governing law and disputes#

These Terms are governed by the laws of India, without regard to conflict-of-law rules. Please contact us first, and we’ll try to resolve any problem informally. If we can’t, the courts of Kolkata, West Bengal, India have exclusive jurisdiction.

If you’re a consumer living outside India, you also keep the protection of any mandatory laws of your home country, and you can bring a claim in your local courts where those laws allow it.

21General#

  • #Entire agreement. These Terms and our Privacy Policy are the whole agreement between you and us about Lune.
  • #Severability. If any part of these Terms can’t be enforced, the rest still applies.
  • #No waiver. If we don’t enforce part of these Terms straight away, we haven’t given up our right to enforce it later.
  • #Assignment. You can’t transfer your rights under these Terms to anyone else. We may transfer ours as part of a sale, merger, or reorganization of Lune, as long as your rights under these Terms aren’t reduced.
  • #Events beyond our control. We aren’t responsible for delays or failures caused by things we can’t reasonably control, such as outages at our providers, network failures, or natural events.
  • #Language. If these Terms are translated, the English version applies.
